TERMS AND CONDITIONS OF SALE
Preamble
These General Terms and Conditions of Sale are entered into between, on the one hand,
SAS Wilma Group (hereinafter referred to as “Wilma Group”), a company with a capital of €5,000

and, secondly, any person wishing to place an order for clothing (hereinafter referred to as “Customers”) through the website “www.wilma.cc”, which is the exclusive property of Wilma Group.

Article 1 - Purpose
Pursuant to Article L. 441-6 of the French Commercial Code and in accordance with Article L. 111-1 of the French Consumer Code, these General Terms and Conditions of Sale govern the sale of any product offered on the website www.wilma.cc by Wilma Group. They are intended to define the mutual obligations of the parties as well as the various steps in the ordering process.
By simply confirming their order on the Website, the Customer declares that they have read, understood, and accepted without reservation the terms of said order as well as these General Terms and Conditions of Sale in their entirety.
These terms and conditions are subject to change. Accordingly, it is understood that the applicable terms and conditions are those in effect on the website at the time the contract is entered into.
Article 2 - Legal Capacity
Customers represent that they are of legal age and have full legal capacity to enter into contracts.
Article 3 - Geographic Areas
Products and services are available only in Europe. For logistical reasons, we are unable to process orders from outside these geographic areas.
Article 4 - Prices of Products for Sale
The prices listed on the website www.wilma.cc are in euros and include VAT. VAT is applied at the rate in effect in mainland France at the time of the order. Product prices are subject to change at any time by Wilma Group. Any change in the VAT rate will be applied immediately to the current order.
Article 5 - Items and Products
The items displayed on the website www.wilma.cc are available for delivery only while supplies last. If a product is out of stock, Wilma Group will notify the buyer as soon as possible by email or phone. The buyer will then have the option to select another item or cancel the order and receive a refund.
Wilma Group strives to describe the products offered for sale as accurately as possible. Prior to placing an order, the Customer may review the essential characteristics of the products they intend to purchase on the Wilma website. However, Wilma Group shall not be held liable for any errors that may have occurred in this presentation. The illustrations and photos of the products accompanying the text are not contractually binding. Under no circumstances shall Wilma Group be held liable on the basis of said illustrations or photos.
Article 6 - Orders
As soon as the Customer definitively confirms their order by clicking on “Confirm Payment,” it is deemed that they have knowingly accepted the content, delivery terms, and conditions of the Order in question, and, in particular, these General Terms and Conditions of Sale, as well as the prices, quantities, descriptions, specifications, volumes, and delivery times of the products ordered by the Customer on the Website.
Wilma Group will acknowledge receipt of this order by sending an email to the Customer who placed the order. Wilma Group reserves the right to cancel or suspend the fulfillment of an Order or its delivery, regardless of its nature or the stage of its fulfillment, in the event of an inability to debit the Customer’s bank account for the order or any amount owed by the Customer, or if a payment issue arises, or in the event of fraud or attempted fraud related to the use of the Wilma Group website, including in connection with previous orders. Finally, if the email address provided by the Customer during registration is incorrect, and if the Customer has not received the Order confirmation email automatically sent by Wilma Group, Wilma Group shall not be held liable. The sale will then be considered final, unless Wilma Group deliberately decides to cancel it, for example, if the ordered products are out of stock. The Customer may, however, exercise their right of withdrawal within 15 days following the date of the order.
Article 7 - Payments
Customers may pay by credit card directly on the website using a Visa, Eurocard, or Mastercard. Payment methods such as bank transfer and cash on delivery are not accepted.
The invoice amount will be debited from the customer's account on the payment date.

Article 8 - Delivery
1. Delivery Areas
The shipping service covers only the following geographic area: the European Union. Wilma Group is not yet able to offer its service in the French overseas departments and territories.
2. Shipping Terms
Pre-ordered products will be delivered to Customers at the address provided in the “My Account” information form completed by the Customer upon registration. In the event of a change of address, it is the Customer’s responsibility to notify us before placing an order by updating their contact information on the “My Account” information form.
For all products (excluding pre-orders), delivery will be made no later than 15 days after the order is confirmed (provided the product(s) are in stock). The customer will receive their order at a pickup location or at their home, depending on the option selected at checkout.
Article 9 - Returns
Our return policy is valid for 14 days. If 14 days have passed since your purchase, we unfortunately cannot offer you a refund or exchange.
To be eligible for a return, your item must be unused and in the same condition as when you received it. It must also be in its original packaging.
Returns are covered only once from mainland France.
If you are returning an item for an exchange, you are responsible for the return shipping costs if the order total is less than €150.
Gift cards cannot be returned.
To complete your return, we need a receipt or proof of purchase.
Please do not return your purchase to the manufacturer.
Refunds (if applicable)
Once we have received and inspected your return, we will send you an email to let you know that we have received your returned item. We will also notify you whether your refund has been approved or denied.
If your refund is approved, it will be processed and a credit will be automatically applied to your credit card or original payment method within a few days.
Late or missing refunds (if applicable)
If you haven't received your refund yet, please check your bank account again first.
Next, contact your credit card company. It may take some time before your refund is officially processed.
Next, contact your bank. There is often a processing delay before the refund is posted to your account.

Exchanges (if applicable)
You may exchange a product within 14 days of receipt. If the exchanged product is more expensive than the original order, we will email you an invoice with a payment link. Once we receive the remaining balance, we will ship the new order.
If you exchange your item for a less expensive one, the price difference will be refunded to you (excluding shipping costs).
Shipping

If you live outside mainland France, you will be responsible for paying the shipping costs to return your item.
If you request a refund, shipping costs are non-refundable. If you receive a refund, the return shipping costs will therefore be deducted from your refund.
The delivery time for your replacement item may vary depending on where you live.
Article 10 - Right of Withdrawal and Time Limits
From the date of receipt of their order, the Customer has fifteen (14) days to return the products ordered. All returns must be sent to the address specified in the previous section. When the right of withdrawal is exercised, a maximum period of fifteen (14) days is required from the date Wilma Group receives the returned product before the amount for the returned product(s) is credited back to the Customer’s credit card account.
Article 11 - Statutory Warranties
The products sold are covered by the statutory warranty of conformity provided for in Articles 211–4 et seq. of the Consumer Code and the warranty against hidden defects (Articles 1641 et seq. of the Civil Code). These warranties cover both hidden and apparent defects as of the date of delivery. Wilma Group’s sole obligationunderthis warranty is, at its discretion, to replace or repair products found to be defective free of charge, without any further compensation or indemnity.
This warranty does not cover damage resulting from misuse of the product, normal wear and tear from use, or failure to follow the washing and care instructions. To be eligible for the product warranty, you must keep the original purchase receipt and the delivery slip.

Article 13 - Confidentiality
This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from the website www.wilma.cc.
Personal Information We Collect.
When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies installed on your device. In addition, as you browse the Site, we collect information about the web pages or individual products you view, the websites or search terms that referred you to the Site, and how you interact with the Site. We refer to this automatically collected information as “Device Information.”

Article 14 - Responsibilities
Wilma Group shall not be held liable for any events, inconveniences, or damages arising from the use of the Internet, including, but not limited to, service interruptions, unauthorized access, or computer viruses.
Furthermore, Wilma Group shall not be held liable for any failure to perform the contract in the event of unforeseeable circumstances, force majeure, disruptions, or total or partial strikes—particularly involving postal services, transportation, and/or communications—as well as flooding or fire. Wilma Group shall not be liable for any indirect damages arising from this agreement, including business interruption, loss of profits, damages, or expenses that may occur.
Article 15 - Allocation of Responsibilities
These General Terms and Conditions of Sale are governed by French law. Any dispute that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the competent courts or the courts of the place where the customer’s order was actually delivered, notwithstanding multiple defendants and/or third-party claims, even in the case of emergency proceedings or provisional measures sought through summary proceedings or by petition.
Article 16 - Intellectual Property Rights
Trademarks, domain names, products, software, images, videos, text, and, more generally, any information subject to intellectual property rights are and remain the exclusive property of Wilma Group.
No transfer of intellectual property rights is made through these Terms and Conditions. Any reproduction, in whole or in part, modification, or use of this content is strictly prohibited.
Article 17 - Amendments to the Terms and Conditions
Wilma Group reserves the right to modify these General Terms and Conditions of Sale at any time. If a Customer does not agree with the new General Terms and Conditions of Sale, the Customer must cancel their subscription by registered letter with acknowledgment of receipt before the new provisions take effect, in accordance with the procedures set forth in the “Right of Withdrawal” section of these General Terms and Conditions of Sale. Rejection of the new General Terms and Conditions of Sale must be explicitly stated; without an explicit expression of intent prior to the new provisions taking effect, the Customer will be deemed to have accepted the changes.
