GENERAL TERMS AND CONDITIONS OF SALE

Preamble

These General Terms and Conditions of Sale (hereinafter “Terms”) are concluded between:

  • SAS Wilma Group (hereinafter “Wilma Group”), a company with a capital of €5,000

  • And any person wishing to order clothing via the website www.wilma.cc (hereinafter “Customer”).

Article 1 – Purpose

In accordance with article L.441-6 of the French Commercial Code and article L.111-1 of the Consumer Code, these Terms govern the sale of all products presented on the website www.wilma.cc by Wilma Group. They define the rights and obligations of the parties as well as the steps of the ordering process.

By confirming their order, the Customer declares to have read, understood, and accepted these Terms without reservation, as well as the order details.

These Terms may be amended at any time. The applicable Terms are those in force on the website at the time of the order.


Article 2 – Legal capacity

The Customer declares they are of legal age and capable of entering into contracts.


Article 3 – Geographic scope

Products and services are offered only within Europe. Sales outside this area are not accepted due to logistical constraints.


Article 4 – Product prices

Prices displayed on www.wilma.cc are in euros, including all taxes (VAT included), according to the VAT rate applicable in metropolitan France at the time of the order. Wilma Group reserves the right to change prices at any time; changes apply immediately to ongoing orders.


Article 5 – Product availability

Products are available while stocks last. In case of unavailability, Wilma Group will notify the Customer promptly by email or phone. The Customer may choose another product or cancel the order for a refund.

Wilma Group strives to describe products accurately. In case of errors, Wilma Group’s liability cannot be engaged. Photos and illustrations are for reference only and are not contractual.


Article 6 – Orders

By confirming the order, the Customer accepts these Terms and the order details.

Wilma Group will confirm the order by email. It reserves the right to cancel or suspend an order in case of non-payment, payment issues, fraud, or attempted fraud.

If the email address provided is incorrect, the sale is deemed final unless Wilma Group cancels it (e.g., due to stock shortage). The Customer has 15 days to exercise the right of withdrawal.


Article 7 – Payment

Payment is made by credit card (Visa, Eurocard, Mastercard) directly on the site. Bank transfers and cash on delivery are not accepted.

The amount is debited on the payment date.

Payment in 3 installments without fees is available.


Article 8 – Delivery

Delivery zones: European Union only (excluding overseas territories).

Delivery terms: Products are delivered to the address provided by the Customer. For address changes, the Customer must update details before ordering.

Products (excluding pre-orders) will be delivered within 15 days after order confirmation, subject to stock availability.


Article 9 – Returns

The Customer has 14 days to return an unused product in its original condition and packaging.

Returns are accepted once only from mainland France.

For exchanges, return shipping costs are borne by the Customer if the order amount is under €150.

Gift cards cannot be returned.

Proof of purchase is required.

Return shipping costs are at the Customer’s expense outside mainland France.

Shipping costs are non-refundable.

Delivery times for exchanged products may vary depending on location.


Article 10 – Right of withdrawal

The Customer may withdraw within 14 days from receipt of the order.

Refunds will be processed within 14 days after receipt and inspection of returned products.


Article 11 – Legal warranties

Products benefit from the legal conformity warranty (articles L.211-4 and following of the Consumer Code) and warranty against hidden defects (articles 1641 and following of the Civil Code).

This warranty does not cover damage caused by misuse, normal wear, or failure to follow care instructions.

The Customer must keep the purchase invoice and delivery receipt to benefit from the warranty.

Article 13 – Privacy

Personal data is collected and processed according to the privacy policy available on www.wilma.cc.


Article 14 – Liability

Wilma Group cannot be held liable for incidents related to Internet use (service interruptions, intrusions, viruses).

Liability is also excluded in cases of force majeure or uncontrollable events (strike, fire, flood, etc.).


Article 15 – Jurisdiction

French law applies. Any dispute will be submitted to the competent courts of the place of effective delivery.


Article 16 – Intellectual property

All elements on the site and products (trademarks, logos, images, texts) remain the exclusive property of Wilma Group. Any reproduction or use is prohibited.


Article 17 – Amendments to the Terms

Wilma Group reserves the right to amend these Terms at any time.

The Customer may refuse changes by terminating their subscription by registered letter before changes take effect.

Without explicit refusal, the Customer is deemed to accept the new Terms.
